Profasee Inc. and its subsidiaries (“Profasee”, “We,” “Us” or “Our”) respect the sensitive nature of any Personal Information provided by its clients (“Customer(s)”, “You”, “Your” or Yourself”). Profasee provides computer services, namely, acting as an application service provider in the field of information management to host computer application software for the purpose of e-commerce, namely, enabling online retailers to monitor, calculate, optimize and dynamically set competitive prices sold through online marketplaces and ecommerce platforms through the use of artificial intelligence and predictive analytics (“Services”) that enable industry-leading players to market, sell, and fulfill items to their customers online (“Buyers”). In so doing, we are committed to maintaining the privacy of all users of the Profasee website and digital platforms (“Profasee Service or Service”), and other Profasee online resources that link to this Privacy Policy (collectively referred to as the “Resources”). Customers, Partners, Buyers, and other users of the Resources are referred to herein collectively as “Users.”
If you are a visitor to a Profasee Service, a recipient of Profasee communications, a customer (paid or free) of the Profasee Service or a teammate of a customer of the Profasee Service then except as expressly set forth below, this Privacy Policy applies to your use of such Service.
This Privacy Policy describes our information collection, storage and disclosure practices in regard to the services that Profasee provides to its Customers. This Privacy Policy pertains to both our online collection of information and to offline collection of information. This Privacy Policy describes the choices you have regarding how Personal Information is collected and used by us and third parties who provide services for us, as well as rights that may be conferred by applicable laws. If you have accessed this Privacy Policy by clicking on the privacy policy link on a site other than the Profasee Website, your information may be collected by Profasee as a service to the entity that controls such other website and the Profasee Privacy Policy terms will apply to the collection of your personal information.
If you are a resident of the European Economic Area (“EEA”), which includes the member states of the European Union (“EU”) or control or process of the Personal Information of EEA Residents, you should consult the sections of this policy relating to the “Rights of EEA Residents” and “International Data Transfers” for provisions that may apply to them. Profasee reserves the right to modify this Privacy Policy to ensure ongoing compliance with Amazon's Acceptable Use Policy and other legal requirements. Changes will be communicated clearly to our users. By using the Resources, you expressly consent to the use and disclosure of your personal information as outlined below.
2.1 “Cookies” mean small data files that may be placed on the hard drive of your computer when you interact with our Resources or a Customer site powered by Profasee. Cookies permit the Profasee server to identify your browser whenever you interact with our Resources or a Customer site powered by Profasee.
2.2 “Personal Information” is information that may be used to directly or indirectly identify an individual (which in some cases, may include certain device information). Personal Information includes (a) names, aliases, postal addresses, unique personal identifiers, online identifiers, Internet Protocol (IP) address, email address, account name, social security number, driver’s license numbers, passport numbers or other similar identifiers; (b) bank account numbers or financial information; (c) commercial information, including records of personal property, products or services purchased, obtained or considered, or other purchasing or consuming histories or tendencies; or (d) internet or other electronic network activity information.
Words used in this Privacy Policy and not specifically defined herein shall have the same meanings as provided in the Profasee Terms of Service accessible via https://profasee.com/terms/terms.
3.1 We will not combine Personal Information or any seller-specific data obtained from Amazon's SP-API with information from other sellers to maintain the integrity and confidentiality of individual data. Most of the Personal Information we collect about individuals is provided to us either by the individuals themselves or by Customers who have or control Personal Information about individuals, such as businesses or employers, in order for us to provide our Services. We may also collect information through technology, platforms including but not limited to Amazon, Inc. and Google Analytics as to how customers and users are using the Resources. Such information may include information about the browser, device, internet connection, IP address, time zone setting, operating system and platform via cookies employed on our Resources.
3.2 We may collect customers’, suppliers’ and end users’ information that is provided to us to provide our Services. We may also collect payment and billing information, as well as records of correspondence with us. It is the obligation of any party other than an individual customer to provide any required notices to the individuals whose Personal Information is submitted to us and to obtain any necessary consents from such individuals.
3.3 When you visit our Website, Profasee may collect automatically submitted information regarding your computer and connection, including previous and subsequent URL, IP address, and page viewing data. Profasee will collect any comments you may send to Profasee and any information you may post to the Resources or a Customer site powered by Profasee. Profasee may also collect information through the use of Cookies (as defined below). Profasee electronically collects and stores personal information you provide when you: (1) register with Profasee, (2) become a Customer or business partner, (3) participate in the purchase for a product listed or sold by a Customer, (4) visit a product page of, or complete a checkout page to purchase, a product of a Customer after clicking on an ad served by Profasee for that Customer, (5) provide comments or submit a problem to Profasee or a Customer, (6) request information from Profasee and provide your name or return contact information, (7) respond to special offers, contests or surveys; or (8) apply for employment with Profasee. Profasee may collect and associate the various types of information described in this paragraph, including information gathered from your visits and interactions with our Website over time, to record your preferences, make the Website easier for you to use, and show you relevant content. Our Resources do not respond to browser “do not track” signals. Customers may choose whether or not to respond to such signals on their own web properties and Profasee has no control over such choices.
3.4 We collect and process Personal Information about individuals to (i) provide the Services for our Customers; (ii) provide answers to inquiries or questions; (iii) perform our contract with and to provide you with Services; (iv) maintain regular communication with you as may be necessary to inform you of updates and other information regarding us and our Services; (v) provide information to third parties with your consent; (vi) improve the Resources to provide you with better Services; and (vii) comply with legal obligations and professional responsibilities. Profasee may, on behalf of and at the direction of Customers using certain Services, electronically collect and store certain personal information about Buyers, which may include IP address, name, email, billing and shipping addresses, purchasing information, product information, and product order information. In addition, Profasee will collect information about Buyers' activities and third-party comments solely for the purpose of individual seller analysis and will not use this data to aggregate insights across multiple sellers' accounts. Bidding and buying history may specifically include Buyers’ histories with respect to any failure to complete sales on winning bids. As part of a registration or checkout process for certain Services, Buyers may be asked to provide contact and billing information and other personal information. Providing some of the requested information is optional, as indicated at the point of collection; however, such information may be needed to make a purchase from a Customer or for Profasee to provide the Services. Customers may be required to provide Profasee with personal information such as name, title, company name, physical address, e-mail address, telephone number, payment information, bank information, username, and password.
3.5 If a customer provides third-party account authentication to us (for example, your Amazon Seller or Vendor account Id or other third party sites.) or otherwise sign in to the Services through a third party site or service, there is some content and/or information in those accounts (“Third Party Account Information”) that may be transmitted into your account with us if you authorize such transmissions, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy; for example, previous Amazon ads campaigns content. Certain information may be required to register with us or to take advantage of some of our features.
3.6 Persons who apply for employment with Profasee will be required to upload a resume or CV and provide their name, mailing address, email address, desired salary information, and work authorization status. Applicants can optionally include a cover letter and information about their social media and communication profiles.
3.7 Profasee will use personal information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by a User or to investigate and address technical issues. Profasee will take reasonable steps to ensure that such information is relevant to its intended use, accurate, complete, and current. Profasee will: (a) notify Users if their personal information is to be disclosed to a third party or used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the User; and (b) provide the User with the opportunity to opt out. Customers can utilize the Resources to remove Buyer personal information pursuant to any request that they receive from Buyers to opt-out. Profasee collects aggregate analytics information for internal use only and ensures that such data does not include insights about Amazon's business or aggregate information across multiple sellers. We use this information to understand how the Services are being configured and used, how they can be improved for the benefit of Users, and to develop new Services.
3.8 We do not sell, trade or license Personal Information about our Customers or any individuals for marketing purposes. We do, however, work with a number of trusted partners who perform vital functions as part of our operations, including managing customer support, facilitating marketing communications by e-mail and post, and other functions. We do not share Personal Information unless it is necessary to fulfill our responsibilities, including providing information or Services to customers.
Profasee uses cookies to improve the functionality of its Resources, to recognize repeat visits by visitors of its Resources, and to collect information about its visitors’ interactions with the Services. These Cookies contain identification information that enables us to streamline your experiences using the Resources. These cookies may be placed by Profasee or by select third party partners we collaborate with. You are always free to set your browser software to decline cookies. However, if you decline cookies, you will be required to re-enter your login information each time you access the Services, and you may not be able to optimize the features of our Resources or the Services. 4.1 Analytics Cookies: These cookies are used to measure website traffic and activity.
4.2 Analytics and Customization Cookies. These cookies collect information that is used to help us understand how our Services are being used or how effective our marketing campaigns are, or to help us customize our Services for you to enhance your experience.
4.3 Advertising Cookies: These cookies help correlate online advertising to a website visitor’s interests by displaying marketing messages that are relevant to a visitor based on a visitor’s browsing history and preferences.
4.4 Essential Cookies. These cookies are strictly necessary to provide you with our Services and to use some of their features, such as access to secure areas. Because these cookies are strictly necessary to deliver the Services, you cannot refuse them without impacting how our Services function.
4.5 Google Analytics. Our Resources might use Google Analytics. We will not assist or permit any third party to pass information to Google that Google could use or recognize as personally identifiable data.

4.7 Sales Tracking Cookies: These cookies help correlate visits and sales on Customer associated retailer websites.
4.8 Social Media Cookies: These cookies are used to integrate the Website with popular social media sites (Facebook, Twitter, etc.). Social Media cookies allow visitors to share content quickly and easily with their social networks.
4.9 Targeting Cookies. These record your visit to our Resources, the pages you have visited and the links you have followed to recognize you as a previous visitor and to track your activity on the Resources and other sites you visit. These Cookies qualify as persistent cookies, because they remain on your device for us to use during a next visit to our Resources. You can delete these cookies via your browser settings.
5.1 Third Party Partners. We may engage third parties to help us carry out certain internal functions such as account processing, customer services, or other data collection relevant to our business. Personal Information is shared with these third parties only to the extent necessary for us to process the transactions you initiate or perform other specific Services. Our partners are legally required to keep Personal Information private and secure.
5.2 Legal Disclosure. We may share Personal Information with law enforcement or other government agencies as required by law or for the purposes of limiting fraud. We reserve the right to disclose Personal Information when we believe that disclosure is necessary to protect our rights or to comply with a judicial proceeding, court order or legal process. We further reserve the right to disclose any Personal Information that we believe, in good faith, is appropriate or necessary to take precautions against liability, to investigate and defend against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Services, or to protect the rights, property or personal safety of us, our Customers or others.
5.3 Other Disclosures. Profasee may, as permitted by applicable law, disclose your personal information to Customers, other Users or third parties in connection with an investigation of fraud, infringement, piracy or other unlawful activity and by using the Resources, you expressly authorize Profasee to make such disclosures. We may also disclose your data to corporate affiliates or in connection with a substantial corporate transaction, such as the sale of a website, a merger or acquisition, consolidation, asset sale, or in the unlikely event of bankruptcy. If Profasee is merged into or acquired by another entity, personal information may be transferred to such entity as a part of the merger or acquisition. Should such a transaction occur, we will require that the other entity follows this Privacy Policy or one substantially similar.
5.4 Domestic and International Use. All personal information collected by Profasee may be: (1) used in the United States; (2) transferred to the United States for use of the Services by a foreign Customer if the Services are undertaken by Profasee for a Customer; or (3) transferred to a Profasee location or Customer outside of the United States. You consent to any such transfer of information outside of your country.
5.5 We will not share Personal Information if such sharing is prohibited by applicable privacy and data protection laws, including, without limitation, the EEA’s General Data Protection Regulation (“GDPR”) or the CCPA.
5.6 Marketing Communications. We will send you email notifications from time to time. Some notifications are marketing communications relating to us or our Services. You may always stop receiving marketing communications by following the directions provided herein.
5.7 Legal / Security Communications. We also send out notices that are required for legal or security purposes some of which are sent for your own protection. In other cases, legal/security notifications involve changes to various legal agreements or policies. We may also send out communications for verification purposes to comply with the CCPA. You may not opt out of such communications.
5.8 Other Communications. We may also send you responses to emails you send us, if appropriate.
If you either (i) have opted to receive marketing information from Profasee, or (ii) are a User residing in the European Union or EFTA States, you may lodge a request regarding your personal information by contacting Profasee through the communication channels provided in this Privacy Policy. You can also ask us to specify what personal information we have about you and to delete certain personal information about you from our records, or request to receive an electronic copy of your personal information for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law). Please let us know what information you would like us to remove from our databases or otherwise let us know what limitations you would like to put on our use of your personal information. For your protection, we may only implement requests with respect to the personal information associated with the particular email address that you use to send us your request. We will need to verify your identity before implementing your request, and you shall provide us with information that we may reasonably need to perform such verification. We reserve the right to share this information with third parties on a need-to-know basis, including third party data controllers who engage our services as a data processor. We, or the relevant data controller, will respond to your requests consistent with applicable law, and we will comply with your request as soon as reasonably practicable. Please note that we may need to retain certain personal information for record keeping purposes and/or to complete any transactions that you began prior to your request for as long as needed or permitted in light of the purposes for which it was obtained. The criteria used to determine our retention periods include the length of time we have an ongoing relationship with you and provide our services to you, our legal obligations or whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations). There may also be residual information that will remain within our databases and other records, but such residual information will no longer be tied to your identity. You should contact the Customer (for example, the seller of an item you have purchased) directly in order to access, modify, or update your personal information with them.
The following section pertains to the rights of individuals or households in California (“California Consumers”). Profasee is committed to compliance with the CCPA, which allows residents of the State of California to remain informed about how Profasee handles information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household (“California Personal Information”) that we have collected from you in any preceding 12-month period. Specifically, this policy discloses the categories of California Personal Information that we collect, use, and disclose in the provision of our services to you. For California Consumers, the provisions of this Section prevail over any conflicting provisions in other sections of this Privacy Policy.
8.1 Civil Code Section 1798.83. Under certain circumstances, California Civil Code Section 1798.83 states that, upon receipt of a request by a California Consumer, a business may be required to provide detailed information regarding how that business has shared that Customer’s Personal Information with third parties for direct marking purposes. However, the foregoing does not apply to businesses like ours that do not disclose Personal Information to third parties for direct marketing purposes without prior approval or give customers a free mechanism to opt out of having their Personal Information disclosed to third parties for their direct marketing purposes.
8.2 Rights under the CCPA. The CCPA provides California Consumers with additional rights regarding Personal Information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly with a particular consumer or household. The categories of Personal Information we collect are generally described hereinabove but differ for individual consumers depending on the Services used by such consumers. Under the CCPA, qualifying California Consumers may have the following rights:
8.2.1 Right to Know and Right to Delete. A California Consumer has the right to request that we disclose what Personal Information we collect, use, disclose and sell. A California consumer also has the right to submit requests to delete Personal Information. When we receive a request to know or delete from a California consumer, we will confirm receipt of the request within a reasonable time, in our sole discretion, and provide information about how we will process the request, including our verification process. We will respond to such requests as required under the applicable law.
8.2.2 Right for Disclosure of Information. A California consumer may also submit requests that we disclose specific types or categories of Personal Information that we collect. Under certain circumstances, we will not provide such information, including where the disclosure creates a substantial, articulable and unreasonable risk to the security of that Personal Information, Customers’ account with us, or the security of our systems or networks. We also will not disclose California Consumers’ social security numbers, driver’s license numbers or other government-issued identification numbers, financial account numbers, any health insurance or medical identification numbers, or account passwords and security questions and answers. In the event that we receive requests from a California consumer who has a relationship with you (for example, from an employee or client of a customer), we will inform you.
8.3 Submitting Requests. If you are a California consumer and would like to make any requests under the CCPA, please direct them to the communication channels provided hereinabove.
8.4 Designated Agent. You may designate an agent to make a request on your behalf. That agent must have access to your account in order for us to verify the request. You may make such a designation by providing the agent with written permission to act on your behalf. We will require the agent to provide proof of that written permission. As permitted by law, we may require you to verify your own identity in response to a request, even if you choose to use an agent.
8.5 Non-Discrimination. Profasee will never discriminate against you, including by denying or providing a different level or quality of services should you choose to exercise your options under the CCPA.
9.1 This section of the Privacy Policy is applicable to residents of the European Economic Area (“EEA”). The EEA consists of the member states of the European Union, i.e., Austria, Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Iceland, Liechtenstein, Norway, and the United Kingdom. This section also applies to residents of Switzerland and, in the event of its departure from the EU, residents of the United Kingdom. Residents of the EEA and Switzerland are referred to here as “EEA Residents.”
9.2 All processing of Personal Information of EEA Residents is performed by us in accordance with the General Data Protection Regulation (2016/679) of the European Parliament and of the Council on the protection of natural persons regarding the processing of Personal Information and on the free movement of such data (“GDPR”).
9.3 Under the GDPR, we are a processor or co-processor of the Personal Information of EEA Residents. Our purpose for collecting and processing Personal Information from or about EEA Residents is to authenticate contacts and to provide our Services to our customers, who may be controllers or processors of Personal Information about EEA Residents. The legal basis for collecting Personal Information is to fulfill these purposes, including contracts between us and those for whom we provide Services. We also rely on your consent to use our Services, including receiving communications regarding our Resources.
9.4 We will not share the Personal Information that we obtain about residents of the EEA with third parties except as described above regarding Personal Information.
9.5 Under the GDPR EEA Residents may also have the right to: obtain confirmation that we hold Personal Information about the resident, request access to and receive information about the Personal Information we maintain about the resident, receive copies of the Personal Information we maintain about the resident, update and correct inaccuracies in Personal Information, object to the continued processing of Personal Information, and have the Personal Information blocked, anonymized or deleted, as appropriate. The right to access Personal Information may be limited in some circumstances by local law. We are also limited by the terms of our agreements with our customers in responding to such requests and may refer any requests received from EEA Residents to our Customers.
9.6 If you qualify, in order to exercise these rights, please contact us through one of the channels of communication provided hereinabove should you have any queries.
If you are resident outside the United States, including in the EEA, we transfer Personal Information provided by Customers for processing in the United States. Under the GDPR, we are considered a processor or co-processor of the Personal Information of EEA Residents and provide processing of data at the request of our customers, who may be controllers or processors of such data. By providing Personal Information to us for the purpose of obtaining information about us and our Services, Customers consent to the processing of such data in the United States. The transfer of Personal Information to the United States is necessary for the performance of a contract between Customers and us. Please note that you may always remove yourself from our mailing list by contacting through the communication channels provided in this Privacy Policy.
We retain the Personal Information we receive as described in this Privacy Policy for as long as Customers use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
As a part of the Services, Profasee provides links to sites operated by third parties. Profasee is not responsible for the information collection or privacy practices or the content of those third-party sites. Users should check the privacy policies of any site prior to use.
Profasee treats data as an asset and therefore stores personal information it obtains using appropriate safeguards. To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, Profasee has put in place appropriate physical, electronic, and managerial procedures to protect personal information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction. However, third parties may unlawfully intercept or access transmissions, and others may abuse or misuse your personal information that they collect from the Resources. You should consider any communication that you transmit to Profasee (such as data, questions or answers, comments, or suggestions) as non-confidential, and agree that Profasee will not be liable or responsible if information that belongs to you is intercepted and used by an unintended recipient. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us using the contact details provided hereinabove.
Our Resources are only intended for individuals who are at least 18 years of age. We do not knowingly encourage or solicit visitors to this website who are under the age of 18 or knowingly collect Personal Information from anyone under the age of 18 without parental consent. If we learn we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us. Profasee uses reasonable efforts not to collect, use or disclose personal information from children under the age of 18 or the applicable age of majority in the relevant jurisdiction. The Services are not targeted at children, and children may not register for any of the Services.
We reserve the right to change our Privacy Policy at any time. If we make changes, we will post them and will indicate on this page the policy’s new effective date. If we make material changes to this policy, we will notify you by email or through notice on the Offerings.
16.1 Section Headings. The section headings contained herein are for reference purposes only and shall not in any way affect the meaning or interpretation of this Privacy Policy.
16.2 Dispute Resolution. Any disputes arising under this Privacy Policy or related documents shall be resolved by the means provided under the Profasee Terms of Service.
17.1 Profasee does not target Amazon Customers for product marketing or review fabrication and modification using data retrieved through the Amazon Services API or any external (non-Amazon) data services.
17.2 Profasee does not use, offer, or promote external (non-Amazon) data services that vend Information or data retrieved from Amazon's websites.
17.3 Profasee does not aggregate data across Authorized Users' businesses or Customers obtained through the Amazon Services API to provide or sell to any parties, including competing Authorized Users.
17.4 Profasee does not promote, publish, or share insights about Amazon's business. Profasee does not use insights about Amazon's business for its own business purposes.
