This Privacy Policy explains how Profasee Inc. collects, uses, discloses, and protects information when you visit profasee.com, create an account, use the Profasee platform, connect ecommerce or advertising Channels, interact with AI Employees, purchase Service Credits, or communicate with us.
This policy applies to website visitors, customers, former customers, prospective customers, account administrators, Users, applicants, partners, and other individuals whose information is processed through the Services. It does not replace any data processing addendum or separate written agreement signed by Profasee.
1. Information We Collect
We collect information you provide directly, information generated by your use of the Services, information from connected Channels, and information from service providers or business partners.
Account and contact information may include name, business name, title, email address, phone number, mailing address, login credentials, account settings, team members, support messages, sales communications, and similar identifiers.
Billing information may include billing address, tax information, payment method status, Stripe customer identifiers, subscription status, invoices, payment history, Service Credit purchases, Service Credit balance, auto-reload settings, usage charges, and billing disputes. Payment card processing is handled by Stripe. Profasee does not store full payment card numbers; we receive limited billing metadata such as payment status, payment method type, card brand, last four digits, and billing contact information.
Channel and ecommerce information may include marketplace, advertising, inventory, fulfillment, catalog, listing, pricing, order, SKU, ASIN, keyword, search term, bid, budget, campaign, placement, sales, margin, COGS, fee, promotion, return, review-related, and operational data that you authorize us to retrieve from Channels or upload to the Services. This information is Customer Data under the Terms.
AI and product usage information may include Inputs, prompts, files, configuration, guardrails, approvals, AI Employee settings, model responses, Outputs, Agent Actions, workflow history, audit logs, tool calls, token counts, usage events, errors, telemetry, and metadata about how the Services operate.
Website and device information may include IP address, browser type, device identifiers, operating system, referral URLs, pages viewed, session events, form submissions, cookies, pixels, analytics identifiers, online identifiers, and approximate location derived from IP address.
Communications information may include email, SMS, call, chat, survey, support, onboarding, sales, and marketing communications, including preferences and opt-out choices.
Profasee does not intentionally collect biometric information, precise geolocation, government ID numbers, health information, or children's information through the Services unless we expressly disclose that collection and have a lawful basis to process it.
For U.S. state privacy law purposes, the categories above may include identifiers, commercial information, internet or electronic network activity, professional or employment-related information, approximate geolocation, audio or communications content if you contact us by call or message, sensitive personal information where credentials or account-access information are processed, and inferences drawn from the information above to support business-to-business services.
2. How We Use Information
We use information to:
- provide, operate, maintain, secure, support, and improve the Services;
- create and manage accounts, authenticate Users, and administer permissions;
- connect to Channels, retrieve Channel data, generate Outputs, and take Agent Actions you enable;
- configure, monitor, troubleshoot, audit, and explain AI Employee behavior;
- process subscriptions, Service Credit purchases, usage deductions, auto-reloads, invoices, taxes, payments, refunds where required, and billing disputes;
- detect, investigate, prevent, and respond to fraud, abuse, prohibited use, competitive misuse, unauthorized access, security incidents, legal violations, Channel-policy violations, breaches of our agreements, and misuse of the Services, including reviewing accounts and usage patterns to identify suspected Competitors as defined in our Terms;
- communicate with you about the Services, security, billing, support, onboarding, product updates, marketing, and legal notices;
- analyze website and product performance, improve user experience, develop new features, benchmark system performance, and create aggregated or de-identified insights;
- comply with law, enforce our agreements, protect rights and safety, and respond to lawful requests.
3. AI Processing and Model Providers
The Services use AI models, agentic workflows, and automation systems. Customer Data, Inputs, Outputs, and usage metadata may be processed by Profasee systems and by model providers, cloud providers, and other Subprocessors to provide the Services.
We do not sell Customer Data. We do not use Customer Data to train third-party foundation models except where you expressly enable that use or request a feature that requires it, and only under provider terms or agreements that apply to Profasee's provision of the Services.
We may use Customer Data, Outputs, telemetry, safety signals, and operational data to improve Profasee-owned systems, ecommerce-specific models, evaluation methods, guardrails, reliability, abuse detection, billing accuracy, and support quality, subject to applicable law, Channel restrictions, and account controls we make available. We may use aggregated, anonymized, or de-identified data for any lawful business purpose, provided it does not identify you, your Users, or any individual and is not used in a manner prohibited by applicable Channel rules.
AI Outputs and Agent Actions may be logged and retained to support auditability, billing, troubleshooting, safety, fraud prevention, compliance, and dispute resolution.
4. Connected Channels and Amazon Information
If you connect a Channel, we process data made available through that Channel according to the permissions you grant, the Channel's API or integration rules, this Privacy Policy, and our agreements with you.
You are responsible for ensuring that you have the right to connect the Channel and allow Profasee to process the related data. You are also responsible for your own privacy notices, consents, and Channel compliance obligations.
For Amazon Information and other marketplace-restricted data, Profasee uses the data to provide the Services to the authorized seller, secure the Services, troubleshoot, comply with applicable marketplace policies, and meet legal obligations. Profasee does not use Amazon buyer information to fabricate reviews, target Amazon buyers for unrelated marketing, sell seller-specific Amazon Information to third parties, or train or improve models that benefit third parties, including other sellers, where prohibited by Amazon policies. Profasee retains Amazon restricted data only as needed for the Services, legal obligations, security, audit, dispute resolution, and marketplace compliance.
5. How We Share Information
We may share information with:
- Affiliates that support Profasee operations;
- service providers and Subprocessors that host, secure, monitor, support, analyze, or operate the Services;
- AI model providers, infrastructure providers, and tool providers used to generate Outputs or run AI Employees;
- payment processors, billing providers, tax providers, and financial operations providers;
- connected Channels and integrations when needed to provide the Services or take Agent Actions you enable;
- communications providers for email, SMS, calls, support, and product notifications;
- analytics and marketing providers for website analytics, attribution, campaign measurement, and marketing communications;
- professional advisors, auditors, insurers, lawyers, and accountants;
- government authorities, law enforcement, regulators, courts, Channels, rights holders, or affected third parties when we believe disclosure is required or appropriate to comply with law, enforce agreements, prevent harm, investigate abuse, protect rights, or respond to legal process;
- successors or counterparties in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction.
We do not sell personal information for money. We may use analytics, advertising, and attribution technologies that could be considered "sharing" for cross-context behavioral advertising, targeted advertising, or similar activity under some state privacy laws. You may use the Privacy Choices page or contact support@profasee.com to exercise legally available opt-out rights.
6. Cookies and Tracking
We use cookies, pixels, local storage, and similar technologies to operate the website, remember preferences, understand traffic, improve performance, measure marketing campaigns, prevent fraud, and support analytics.
Cookie categories may include:
- strictly necessary cookies for security, routing, forms, authentication, billing, fraud prevention, and service operation;
- functional cookies for preferences and product experience;
- analytics cookies for traffic, performance, session events, conversion measurement, and product analytics;
- marketing cookies and pixels for attribution, remarketing, campaign measurement, and ad performance.
You can control cookies through your browser settings and available privacy controls. Some parts of the website or Services may not work correctly without certain cookies. More detail is available in our Cookie Policy and Privacy Choices page.
7. Legal Bases for EEA, UK, and Similar Jurisdictions
Where required, our legal bases may include performance of a contract, legitimate interests, consent, legal obligation, and protection of rights and safety.
Our legitimate interests include operating and improving the Services, securing systems, preventing fraud and abuse, supporting customers, measuring product performance, developing features, enforcing agreements, and marketing to business contacts in a reasonable manner. Where required, we assess and balance those interests against affected privacy rights.
We rely on contract where processing is needed to provide the Services or administer an account, consent where legally required for certain marketing or optional processing, legal obligation where law requires processing or retention, and legitimate interests for business-to-business operations, security, fraud prevention, product improvement, and enforcement.
You may withdraw consent where processing is based on consent, but withdrawal will not affect prior lawful processing and may limit your ability to use some features.
8. Your Privacy Rights
Depending on where you live, you may have rights to access, correct, delete, port, restrict, or object to processing of personal information. You may also have the right to opt out of certain sale, sharing, targeted advertising, profiling, or automated decision-making uses as defined by applicable law.
California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Tennessee, Indiana, New Jersey, and other U.S. state residents may have rights under applicable state privacy laws. The exact rights, verification standards, appeal rights, and response deadlines depend on the state law that applies to your request.
To make a request, use our Privacy Choices page or contact support@profasee.com. We may need to verify your identity and authority before responding. If your information is processed on behalf of a Profasee customer, we may direct your request to that customer.
Profasee will not discriminate against you for exercising legally available privacy rights. If a state law gives you a right to appeal our decision, you may appeal by replying to our response or contacting support@profasee.com with "Privacy Appeal" in the subject.
9. Automated Processing and Human Review
The Services use automated systems to analyze ecommerce, advertising, inventory, pricing, catalog, and operational data. Those systems may generate recommendations, forecasts, scores, classifications, alerts, and Agent Actions when you enable them.
Profasee's Services are designed for business operations, not for making decisions about an individual's legal rights, credit, insurance, housing, employment, benefits, medical care, or similar high-risk personal decisions. Those uses are prohibited by the Usage Policy unless Profasee expressly permits them in writing and all required safeguards are in place.
Where applicable law gives an individual rights related to automated decision-making or profiling, you are responsible for handling those rights for decisions you make using the Services, and Profasee will provide reasonable assistance where required by law and applicable written terms.
10. Communications Choices
You may opt out of marketing emails by using the unsubscribe link or contacting us. You cannot opt out of transactional, billing, security, legal, or service-related notices.
If you opt into SMS from Profasee, you consent to receive texts at the number you provide. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help where supported. Consent to marketing SMS is not a condition of purchase. SMS availability depends on carrier support and the phone number you provide.
If you use the Services to send or manage messages to your own customers, buyers, sellers, employees, contractors, or other recipients, you are responsible for all required consent, disclosures, opt-out handling, quiet-hour compliance, sender registration, and communications-law compliance.
11. Retention
We retain information for as long as needed to provide the Services, maintain business records, administer billing, resolve disputes, satisfy legal, accounting, tax, security, and compliance obligations, enforce agreements, and protect rights.
Typical retention periods or criteria include:
- account and billing records: during the account term and generally up to seven years after closure where needed for tax, accounting, audit, and dispute purposes;
- Customer Data from connected Channels: during the account term and for a reasonable deletion or export period after closure, subject to backups, Channel requirements, legal holds, security, and dispute needs;
- Amazon restricted data: only as needed for the Services, legal obligations, security, audit, dispute resolution, and marketplace compliance, with shorter retention where Channel rules require it;
- AI usage logs, audit logs, Agent Actions, and security records: as needed for billing, auditability, safety, abuse prevention, dispute resolution, and security;
- website analytics and marketing data: according to the applicable tool settings, legal requirements, and business need;
- support and communications records: as long as needed for support history, training, quality, dispute resolution, and legal compliance.
Information may be deleted, de-identified, aggregated, or retained in backups until backup cycles expire. We may retain information longer where required or permitted by law.
12. Security and Incident Notice
Profasee uses reasonable administrative, technical, and organizational safeguards designed to protect information. These may include access controls, encryption in transit, vendor review, logging, monitoring, and operational security processes appropriate to the nature of the Services.
No method of transmission or storage is fully secure. You are responsible for protecting your credentials, limiting User access, configuring appropriate permissions and guardrails, and promptly notifying us of suspected unauthorized access.
If Profasee becomes aware of a confirmed security breach involving personal information under Profasee's control, we will notify affected customers without undue delay and in accordance with applicable law, Channel requirements, and any written data processing terms signed by Profasee.
13. International Transfers
Profasee is based in the United States, and information may be processed in the United States and other countries where we or our service providers operate. Those countries may have data protection laws different from your country.
Where required, we use appropriate transfer mechanisms, which may include Standard Contractual Clauses, the UK Addendum or International Data Transfer Agreement, adequacy decisions, or another lawful mechanism. If Profasee participates in a specific transfer framework, we will identify it in this policy or another public notice.
14. Children and Age
The Services are for business users and are not directed to children or teenagers. You must be at least 18 years old to use the Services.
We do not knowingly collect personal information from children under 13 or the age required by applicable law, and we do not knowingly process personal information from individuals under 16 for targeted advertising, sale, or sharing. If you believe a child provided personal information to us, contact support@profasee.com.
15. Changes
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice by posting the updated policy, sending email, or providing an in-product notice. Where applicable law requires consent for a material expansion of processing, we will obtain consent before applying that processing.
Continued use of the Services after the effective date means the updated policy applies.
