Usage Policy

This Usage Policy governs use of the Profasee Services, including the Profasee platform, AI Employees, workflows, automations, APIs, Agent Actions, Outputs, Service Credits, and related features. It is incorporated into the Terms of Service.

Violating this Usage Policy is a material breach of the Terms. Profasee may throttle, restrict, suspend, terminate, block, reverse, disable, investigate, report, or take other action if we believe use of the Services violates this policy, law, Channel policy, third-party rights, Profasee rights, or creates risk for Profasee, customers, Channels, or third parties.

1. General Rule

Use the Services only for lawful ecommerce and business operations. Do not use the Services to cause harm, evade accountability, mislead consumers, violate Channel rules, violate law, violate Profasee brand or trademark rights, or build a competing AI system.

These examples are not exhaustive. Profasee may decide in its reasonable judgment whether a use is prohibited.

2. Illegal Activity, Sanctions, and Export Controls

You may not use the Services to:

  • violate law, regulation, court order, sanction, embargo, export control, or governmental directive;
  • conduct, facilitate, or promote money laundering, terrorist financing, tax evasion, bribery, fraud, counterfeiting, or other criminal activity;
  • sell, advertise, price, distribute, or manage unlawful goods or services;
  • process stolen goods, counterfeit goods, recalled goods, unsafe goods, or goods bearing marks you are not authorized to use;
  • evade sanctions, export controls, restricted-party lists, or geographic restrictions;
  • use the Services if you are listed on a restricted-party list or are located in, organized under the laws of, or ordinarily resident in a jurisdiction subject to comprehensive U.S. sanctions or embargoes, including Cuba, Iran, North Korea, Syria, the Crimea region, the so-called Donetsk People's Republic region, the so-called Luhansk People's Republic region, or any other restricted jurisdiction designated by the U.S. government.

You are responsible for screening your products, users, counterparties, customers, and Channels where required by law.

3. Fraud, Deception, and Consumer Harm

You may not use the Services to:

  • create deceptive pricing, false reference pricing, fictitious discounts, hidden fees, bait-and-switch offers, or misleading promotional claims;
  • engage in price gouging or emergency-pricing violations;
  • make false, deceptive, or unsubstantiated product, health, safety, environmental, performance, income, or financial claims;
  • omit legally required disclosures, warnings, labels, country-of-origin information, allergen information, regulated-product notices, or AI-use disclosures;
  • conduct click fraud, conversion fraud, attribution fraud, affiliate fraud, ad fraud, review fraud, or marketplace fraud;
  • generate, purchase, suppress, manipulate, or retaliate over reviews, ratings, testimonials, or endorsements in violation of law or Channel policy.

4. Marketplace and Channel Compliance

You must comply with each Channel's terms, seller agreements, advertising policies, listing rules, API rules, rate limits, data policies, fee schedules, prohibited-product policies, and anti-automation restrictions, including where applicable Amazon's seller policies and Selling Partner API policies, Google Ads Policies, Meta Advertising Standards and Commerce Policies, Walmart Marketplace Retailer Performance Standards, Shopify policies, eBay policies, and TikTok Shop policies.

You may not use the Services to:

  • bypass Channel API limits, scraping restrictions, automation restrictions, bot restrictions, or account controls;
  • coordinate prices, bids, budgets, inventory, market allocation, or competitive strategy with other sellers in violation of antitrust law or Channel policy;
  • manipulate Buy Box eligibility, search rank, Best Sellers Rank, review systems, ad auctions, catalog systems, attribution systems, or inventory signals in violation of law or Channel policy;
  • create duplicate listings, fraudulent ASINs, misleading SKUs, listing hijacks, unauthorized variations, or keyword abuse;
  • piggyback on, redirect, or interfere with another seller's listings, brands, detail pages, or ads in violation of Channel policy or IP rights.

5. Pricing, Bidding, and Inventory

You may not configure AI Employees, Agent Actions, or workflows to:

  • engage in price fixing, bid rigging, market allocation, group boycotts, monopolization, predatory pricing, below-cost dumping, or other anticompetitive conduct;
  • violate minimum advertised price policies, resale-price obligations, emergency price-gouging rules, consumer protection laws, or regulated-pricing rules;
  • ask Profasee to configure agents or workflows to facilitate minimum advertised price violations, resale-price violations, or unlawful pricing coordination;
  • intentionally create artificial scarcity, false availability, inventory manipulation, or deceptive urgency;
  • ignore legally required price, ad, or inventory guardrails.

You are responsible for configuring price floors, price ceilings, bid caps, budget caps, inventory limits, product exclusions, and other guardrails appropriate for your business and jurisdictions.

6. Advertising and Customer Communications

You may not use the Services to:

  • place or optimize ads that violate the FTC Act, Lanham Act, state consumer protection laws, platform ad policies, endorsement rules, or regulated-product advertising rules;
  • target ads in a discriminatory or unlawful manner;
  • create deepfakes, synthetic endorsements, fake expert claims, AI-generated likenesses of real people, or name, image, voice, or likeness uses without required consent and disclosures;
  • create or distribute non-consensual intimate imagery, sexually explicit deepfakes, or deceptive synthetic media in violation of law or platform policy;
  • send spam, unlawful marketing, unlawful SMS, unlawful email, robocalls, or messages without required consent;
  • impersonate another person or business or misrepresent affiliation, sponsorship, or endorsement.

If applicable law or Channel policy requires disclosure that content, chat, messaging, recommendations, images, audio, video, or other media is AI-generated or AI-assisted, you are responsible for making that disclosure.

7. Intellectual Property and Data Rights

You may not use the Services to:

  • infringe, dilute, misappropriate, or violate patents, copyrights, trademarks, trade secrets, publicity rights, privacy rights, or other rights;
  • generate, upload, list, advertise, or distribute infringing product images, copy, listings, creative, keywords, or product content;
  • scrape, collect, process, or enrich personal information without lawful basis, required notice, and required consent;
  • process protected health information under HIPAA, payment card data in violation of PCI-DSS, children's personal information in violation of COPPA or similar laws, or other data you are not authorized to process.

8. Security and Service Abuse

You may not:

  • upload, transmit, generate, or distribute malware, ransomware, spyware, viruses, worms, credential harvesters, or harmful code;
  • probe, scan, test, attack, overload, or attempt to breach the Services or any system connected to the Services;
  • use prompt injection, jailbreaking, model extraction, model inversion, adversarial inputs, or data exfiltration techniques to bypass safety controls or extract non-public information;
  • scrape, harvest, cache, replay, or automate collection of model Outputs, traces, prompts, responses, or usage records at scale except as expressly permitted by Profasee;
  • access another customer's data, account, prompts, Outputs, usage records, or Channel data;
  • bypass rate limits, access controls, authentication, authorization, billing controls, safety controls, monitoring, guardrails, or usage restrictions;
  • interfere with service integrity, availability, security, or performance.

9. Prohibited Content and Products

You may not use the Services to list, advertise, price, optimize, sell, or manage:

  • child sexual abuse material, sexual exploitation, non-consensual intimate imagery, sexually explicit deepfakes, or content exploiting minors;
  • content that incites violence, threatens, harasses, or promotes hatred or discrimination based on protected characteristics;
  • self-harm instructions, suicide encouragement, or eating-disorder encouragement;
  • unlawful weapons, firearm accessories, explosives, ammunition, precursor chemicals, or controlled substances;
  • tobacco, vaping, cannabis, CBD, alcohol, pharmaceuticals, medical devices, supplements, hazardous materials, wildlife, or other regulated goods unless lawful, properly licensed, and permitted by each Channel;
  • counterfeit, recalled, stolen, unsafe, banned, or unauthorized goods.

10. High-Risk Uses

You may not use the Services, Outputs, or Agent Actions for:

  • medical diagnosis, treatment, prescribing, clinical triage, or healthcare decisions;
  • legal advice, legal interpretation, or determinations with legal consequences;
  • credit, lending, insurance, housing, employment, benefits, eligibility, or similar decisions affecting individuals;
  • critical infrastructure, emergency services, law enforcement, surveillance, biometric identification, social scoring, election administration, weapons systems, or use cases that could cause death, personal injury, severe economic harm, or civil-rights harm.

If a use affects individuals or consumers in a material way, you are responsible for legally required human review, professional review, disclosures, appeal rights, and recordkeeping.

11. Agentic Use Standards

Before enabling Agent Actions, you must understand the authority you are granting, configure appropriate guardrails, and monitor activity.

You may not:

  • instruct or configure AI Employees to violate law, Channel policy, third-party rights, the Terms, or this Usage Policy;
  • chain Profasee agents with third-party tools or scripts to defeat safety controls, throttling, usage limits, billing controls, audit logs, or guardrails;
  • use agents to take actions requiring professional licensure unless a properly licensed human is responsible and all legal requirements are met;
  • ignore, suppress, or bypass warnings, approvals, stops, or limits provided by the Services.

If Outputs or AI Employees interact directly with consumers, end users, sellers, buyers, support recipients, or the public, you are responsible for legally required notices, AI disclosures, consent, opt-out rights, human review, recordkeeping, and escalation paths.

12. Competing Model and Product Restrictions

You may not use the Services, Outputs, prompts, usage data, traces, model behavior, or data derived from the Services to:

  • build, train, fine-tune, evaluate, benchmark, distill, copy, or improve a competing AI model, agentic system, repricing system, advertising automation system, marketplace optimization product, or related service;
  • extract model weights, prompts, system instructions, architecture, non-public Documentation, training data, safety classifiers, or proprietary methods;
  • scrape model Outputs at scale through APIs, browser automation, extensions, scripts, or other automated collection methods;
  • create datasets, embeddings, evaluations, or benchmarks for resale, distribution, or competitive intelligence against Profasee.

You also may not, and may not allow anyone else to:

  • access the Services if you are a Competitor as defined in the Terms, or on behalf of, at the direction of, or for the benefit of a Competitor;
  • access the Services for the purpose of competitive intelligence, replication of features, recreation of workflows, recreation of user interface, recreation of agent designs, replication of prompts or system instructions, or any other purpose intended to inform the design, development, or marketing of a competing product;
  • capture, record, screenshot, screen-record, scrape, or otherwise reproduce the user interface, workflows, dashboards, recommendations, configurations, or any other element of the Services for use in product development, marketing, training, demonstration, sales, or competitive analysis by any party other than you for your own internal business operations;
  • publish, post, or share screenshots, screen recordings, videos, or written descriptions of the Services that depict the user interface, agent configurations, system prompts, evaluation criteria, recommendations, or any other Profasee Confidential Information, without Profasee's prior written consent;
  • conduct or commission benchmarking, performance testing, accuracy evaluation, or comparative analysis of the Services for public disclosure or use against Profasee, including in marketing, advertising, blog posts, podcasts, courses, conference talks, social media, analyst briefings, or sales collateral.

Profasee may, in its reasonable judgment, designate a specific company, product, or person as a Competitor by written notice to the Account. Continued use of the Services following such notice is a violation of this Usage Policy.

13. Service Credits and Account Integrity

You may not:

  • sell, transfer, gift, trade, broker, pool, or exchange Service Credits;
  • exploit pricing bugs, credit bugs, conversion errors, promotional errors, metering errors, or checkout errors;
  • create multiple accounts to evade limits, suspensions, trials, enforcement, billing, or usage restrictions;
  • share credentials, API keys, or User logins;
  • charge back or reverse payments after usage has been consumed except through the billing dispute process in the Terms and without waiving non-waivable chargeback rights.

Profasee may claw back credits, reverse balances, correct errors, suspend accounts, or require repayment where Service Credits were obtained or used improperly.

14. Monitoring and Enforcement

Profasee may use automated and human review to detect, investigate, prevent, and respond to violations. We may log, store, and analyze Inputs, Outputs, Agent Actions, usage records, Channel metadata, and account metadata for safety, security, abuse detection, quality assurance, billing, legal, and compliance purposes.

If we believe a violation has occurred or is likely, we may:

  • issue warnings or require additional verification;
  • block, modify, reverse, or refuse Inputs, Outputs, Agent Actions, workflows, or Channel connections;
  • throttle, rate-limit, restrict, disable, suspend, or terminate access;
  • disable Agent Actions while allowing read-only access;
  • retain data for investigation, legal, security, or compliance purposes;
  • forfeit or claw back Service Credits where permitted by the Terms and Service Credit Terms;
  • report violations to Channels, law enforcement, regulators, rights holders, payment processors, affected parties, or security organizations;
  • pursue civil, equitable, or criminal remedies.

Profasee may publish enforcement trends or decisions in aggregated or anonymized form for transparency, trust and safety, or abuse-prevention purposes.

Profasee has no obligation to enforce this policy in every instance. A decision not to enforce in one instance is not a waiver.

15. Reporting

Report suspected policy violations to trust-and-safety@profasee.com.

Report security issues to security@profasee.com. Profasee will triage security reports in a commercially reasonable manner and prioritize urgent, exploitable, or customer-impacting issues.
